The Centers for Disease Control and Prevention asked the Department of Justice Wednesday to appeal a federal judge’s injunction against its travel mask mandate in order “to protect CDC’s public health authority.”
“It is CDC’s continuing assessment that at this time an order requiring masking in the indoor transportation corridor remains necessary for the public health,” the CDC said in a statement.
The agency said that it would continue to “monitor public health conditions” to determine whether the mask mandate remains necessary, and recommended that people continue to wear masks on indoor public transportation.
The Florida District Court judge struck down the agency’s mask rule on Monday, raising questions about the agency’s authority to impose the mandate. The CDC added in its statement that it believes its order is “lawful” and “well within CDC’s legal authority to protect public health.”
